What Is Family-Based Immigration in the U.S.?

Family-based immigration is a key part of U.S. immigration law, designed to reunite family members while promoting community integration and stability. It allows U.S. citizens and lawful permanent residents to sponsor certain relatives to join them in the United States.

This process relies on two main categories of visas:

  1. Immediate Relative Visas – For close family members such as spouses, parents, and unmarried minor children of U.S. citizens.
  2. Family Preference Visas – For other relatives, such as siblings or married adult children, with annual limits on the number issued.

The family-based immigration system reflects the value placed on keeping families together and recognizes the vital role that family support plays in the success of immigrants building new lives in the U.S.

How to Sponsor a Family Member for a Green Card in Texas

Sponsoring a family member for a green card involves a structured process that adheres to strict guidelines. Here’s what you need to know about the steps involved:

Step 1: Confirm Eligibility

Eligibility depends on your status as a U.S. citizen or lawful permanent resident and your relationship to the family member you wish to sponsor. Immediate relatives of U.S. citizens, such as spouses and parents, typically face fewer restrictions than extended relations.

Step 2: File Form I-130

The first step in the petition process is completing and submitting Form I-130, Petition for Alien Relative. This establishes the nature of your relationship and begins the process of application for residency.

Step 3: Visa Processing

After USCIS approves the I-130, the case is forwarded to the National Visa Center (NVC). At this point, additional documentation, such as financial and civil documents, must be submitted. The applicant will also undergo an in-person interview at a U.S. embassy or consulate abroad.

Step 4: Affidavit of Support

Sponsors need to provide evidence of financial capability through an Affidavit of Support (Form I-864), assuring the U.S. government that the sponsored family member will not become dependent on public resources.

We know these steps can feel overwhelming, but you’re not alone — our role is to guide you through every stage.
